The VA rep who so candidly called him last year to tell him they were taking his monthly pay, admitted it was a clerical error on the VAs part as to why this wasn’t done before hand. With an appeal and all of the federal laws in place, it shouldn’t have been taken. He appealed it, he brought up the Havens Act as well as the fact that VA Debt collection is supposed to be suspended through September 2021. Then the slap in the face was taking his compensation. My husband has PTSD and has not received the proper care or rating for such. I’m sure it’s because he was trying to increase his rating and this was retaliation. However they’ve waited for 10 years to do it. Not to mention, the Bill that apparently says this is legal also states that they should’ve recouped that before he was ever given a disability pay.
